Property Damage
Property Damage Claim Information
Generally a property damage claim may arise
in any of the ways that a personal injury claim arises.
A product defective may cause property damage instead of personal
injury. A defective condition on property (such as blocked culverts
which cause general flooding during heavy rains) can give rise to
property damage claims rather than personal injury. Even negligent
driving of an automobile can give rise to damage to a building
or other property- rather than an injury to a person. Please
review the type of accident which caused your property damage
to occur in the menu on the left for more information.
In order to obtain the services of an attorney on a contingency fee
for the purpose of recovering lost value due to property damage, the
damage has to be in the tens or even hundreds of thousands of
dollars. This unfortunate situation puts many people with
property damage claims at the mercy of unscrupulous insurance
companies. These insurers feel that they can deny and delay
property damage claims (such as collision damage claims in a
car accident case) and eventually compel the claimant to
settle for far less than the value of their claims. If you
have are able to acquire proof that an insurer is doing this to
you, then you may have a bad faith claim against the insurer
involved. For more information, please visit our

Deadlines to File Property Damage Claims
The deadline for most property damage claims in Hawaii is two (2) years
from the date of the accident.
It should be noted, however, that there are
exceptions to this rule- for example, claims
against the City and County of Honolulu and
the various other Counties must be filed with the appropriate agency
within six (6) months of the date of the accident.
You must file your claims in
court prior to the expiration of such deadlines, or your
claims may be lost—regardless of their merit.
To be wise it is recommended that you immediately contact an attorney
after an accident giving rise to injuries occurs- please do not
